Absence of a guarantee of proper performance of activity under concession as a negative premise of granting a concession

Abstract:

The circumstance of an absence of a guarantee of proper performance of activity under concession should be considered as a negative premise of granting a concession, although it is not reflected in a catalogue including negative premises of granting concession, which is regulated in the Act of Freedom of Economic Activities. Deliberations on provisions relating to a guarantee of a proper performance of activity under concession and provisions including other negative premises of granting a concession argue in favor of adopting that position. At the same time, that position is not contrary to the principle of economic freedom.
