Abstract:

A local self-government unit is not only a public law entity but also a legal entity acting in the conduct of civil law transactions. That is why it is entitled to claims for indemnity which it can vindicate before a common court of law from the State Treasury and other entities. These claims may result from the damage caused by illegal actions or cessation when exercising public power and on account of non-performance or misperformance of obligations, or due to illicit acts. The rules and procedure of the vindication of claims in this respect are regulated in the provisions of the civil code, and the local self-government unit’s rights are in this area the same as the rights of other civil law entities.
