  Einige Impulse aus den Anfängen einer allmählich entstehenden kommunalen Selbstverwaltung in Deutschland tragen bis heute zu deren Stabilität bei. Zugleich brachte ihre weitere historische Entwicklung jedoch auch Strukturen hervor, die sie in der Gegenwart einer allmählichen Erosion aussetzen. Der Beitrag beschreibt zur Veranschaulichung dieser Ambivalenz zunächst die Herausbildung einer starken Autonomie der Städte im Hoch- und Spätmittelalter als Folge ihrer wirtschaftlichen Prosperität und politischen Eigenständigkeit sowie die Herausbildung erster Grundstrukturen einer modernen kommunalen Selbstverwaltung nach den Napoleonischen Kriegen. Die in der letztgenannten Phase vor allem in Preußen entwickelte Doppelfunktion der Kommunalbehörden als Teil staatlicher Verwaltung und bürgerschaftlicher Selbstorganisation prägte und prägt das System der kommunalen Selbstverwaltung in Deutschland bis heute. Anhand konkreter Beispiele wird in dem Beitrag veranschaulicht, wie der Bund und die Bundesländer als staatliche Akteure diese Doppelfunktion zur exekutiven Umsetzung ihrer in Rechtsnormen gegossenen politischen Agenda nutzen, ohne Rücksicht auf die dafür erforderlichen politischen und wirtschaftlichen Ressourcen zu nehmen. Zugleich werden Anzeichen einer fortbestehenden gesellschaftlichen Vitalität der kommunalen Selbstverwaltung skizziert.

  Certain impulses from the beginnings of the gradual emergence of municipal self-administration in Germany still contribute to its stability today. At the same time, however, its further historical development also created structures that expose municipial self-administration to gradual erosion in the present day. To visualise this ambivalence, the article describes the formation of a strong autonomy of the cities in the High and Late Middle Ages as a result of their economic upturn and their political independence as well as the occurance of the first basic structures of modern municipal self-government after the Napoleonic Wars. In the last-mentioned phase, the dual function of local authorities emerged, particularly in Prussia, on the one hand as part of the state administration and on the other as an element of civic self-organisation. This system still characterises municipal self-government in Germany today. Using concrete examples, the article illustrates how the federal and state governments use this dual function for the executive implementation of their political agendas, which have been codified in legal norms, regardless of the political and economic resources required for this. Moreover, signs of the continued social vitality of local self-government are outlined.

  Stabilność samorządu terytorialnego w Niemczech determinują do dziś niektóre elementy ukształtowane w czasie powstawania tej instytucji. Jednocześnie ich dalszy rozwój historyczny dał również początek strukturom, które w dzisiejszych czasach narażają je na stopniową erozję. Aby zilustrować tę ambiwalencję, w artykule opisano najpierw rozwój silnej autonomii miast w okresie rozkwitu oraz późnego średniowiecza wynikający z dobrobytu gospodarczego i niezależności politycznej, a także rozwój pierwszych podstawowych struktur nowoczesnego samorządu miejskiego po wojnach napoleońskich. W ostatniej z wymienionych faz, zwłaszcza w Prusach, powstała podwójna funkcja władz lokalnych w ramach administracji państwowej i samorządu obywatelskiego, która ukształtowała i do dziś nadal kształtuje system samorządu lokalnego w Niemczech. Posługując się konkretnymi przykładami, artykuł ilustruje, w jaki sposób rząd federalny i kraje związkowe jako podmioty państwowe wykorzystują tę podwójną funkcję do realizacji swojego programu politycznego, która jest ujęta w normach prawnych, bez uwzględnienia niezbędnych do tego zasobów politycznych i gospodarczych. Jednocześnie w artykule podkreślono symptomy utrzymującej się żywotności społecznej samorządu lokalnego.
