Abstract:

The police state was the predecessor of the state of law, and its fundamental feature was the concentration in the hands of the ruler all types of power: legislative, executive and judicial one. The purpose of an administration in this state was to serve and upkeep the power of the ruler – act in his interest, and its scope was described by the term of policy. The state of law (with its developed form: the democratic state of law) is in turn the opposite of the police state. In this state the sovereign power belongs to the nation, its polity is based on universally binding legal order and separation and balance of public powers, and its mission is to promote public interest. Unfortunately, the essence of the state of law may be distorted by its politicization, which is exemplified by concentration of public power in one political center and converting public interest into the particular interest of the ruling political party.
