Safety on roads as ultima ratio or simply an argument for restricting competence of self-governmental executive bodies?

Abstract:

The article presents one of the possibilities of implementing a general clause of “security” and “public order” as an effective instrument to legitimize imperious actions of the State. The author argues that a general clause included in art. 31(3) of the Constitution of the Republic of Poland can be regarded as an argument which may effectively restrict the competence of self-government executive bodies concerning the right to develop their own policies in the area of road traffic.
