Abstract:

The article aims to present the questions of ensuring equal access to health care, prevention of inequality and discrimination in access to health care under Community law, as well as review the regulations that increasingly affect the shaping of the Health Policy of the Member States by the European Union. The analysis is conducted in the context of both the provisions of the EU treaties and the regulations contained in the Charter of Fundamental Rights of the European Union, as well as laws made by the Community, case law, and programs supporting health policy. The article, therefore, presents the most important documents relating to the fight against inequality and discrimination in this area, which is one of the key areas of the European Union’s commitment to health care and public health. Also discussed herein is the issue of the cross-border provision of healthcare services and reimbursement for medical treatment by EU Member States, in the context of health inequalities which may arise in connection with EU nationals’ freedom to receive health services abroad within EU territory
