Abstract:

Due to the fact that artificial intelligence has entered the sphere of culture, becoming an extremely important field for copyright, the aim of the article is to answer the question of who can we consider as the author of works created by artificial intelligence. The author analyzed the concept of a work within the meaning of copyright law on the basis of Polish and European Union regulations, international convention and jurisprudence of the Court of Justice of the European Union. She pointed out the connection of the concept of authorship in the European Union copyright law with the requirement of originality, which should be understood as the author’s own intellectual creation. When trying to answer thequestion of who should one consider as the author of works created by artificial intelligence, the programmer, user, investor and machine were taken into account.  

Ze względu na to, że sztuczna inteligencja wkroczyła w sferę kultury, stając się dla prawa autorskiego niezwykle ważną dziedziną, celem niniejszego opracowania jest odpowiedź na pytanie, kogo możemy uznać za twórcę utworów stworzonych przez sztuczną inteligencję. Autorka przeanalizowała pojęcie utworu w rozumieniu prawa autorskiego na gruncie przepisów polskich, unijnych, konwencji międzynarodowej oraz orzecznictwa TS. Wskazała przy tym na powiązanie w prawie autorskim UE pojęcia autorstwa z wymogiem oryginalności, który należy rozumieć jako własną intelektualną twórczość autora. Próbując odpowiedzieć na pytanie, kogo uznać za twórcę utworów stworzonych przez sztuczną inteli-gencję, autorka wzięła pod uwagę programistę, użytkownika, inwestora oraz maszynę.
