Abstract:

Im Rahmen der Publikationsreihe „Durchbruch in den deutsch-polnischen Beziehungen 1989–1991 im Lichte polnischer politischer Dokumente. Eine Dokumentenauswahl“ des Willy Brandt Zentrums für Deutschland- und Europastudien der Universität Wrocław (Polen) ist auf Polnisch der vierte Band mit dem Titel „Symbolischer Akt. Leistungen aus Deutschland für die Opfer der NS-Verbrechen in Polen. Die 'pragmatische' Formel im Lichte der Abkommen von 1991 und 2000“. Einleitung, Auswahl und Zusammenstellung von Jan Barcz und Krzysztof Ruchniewicz erschienen. Die Veröffentlichung besteht aus zwei Teilen. Der erste Teil enthält Rechtskommentare, die eine inhaltliche Einführung in den zweiten Teil bieten. Ihre Autoren sind die Professoren für Völkerrecht Jan Barcz, Witold M. Góralski und Jerzy Kranz. Der zweite Teil enthält Dokumente der polnischen Diplomatie und außerdiplomatisches Material. Diese Quellen werden oft zum ersten Mal veröffentlicht. Die Absicht der Herausgeber war es, eine Lücke in der vorhandenen Literatur zu schließen. Die jüngsten öffentlichen Diskussionen unter Beteiligung von Politikern, Publizistinnen und einigen Forschenden haben uns gezeigt, dass der Wissensstand in dieser schwierigen Materie höchst unzureichend ist und nicht der Bedeutung dieses Themas entspricht. Der vorliegende Band sollte als letzter der Reihe erscheinen, doch aufgrund der Aktualität des Themas Reparationen und zivilrechtliche Wiedergutmachung wurde beschlossen, die Reihenfolge der einzelnen Bände zu ändern. Die elektronische Version (auf der Grundlage von OpenAccess) wird demnächst durch eine Papierversion ergänzt.  

As part of the publication series "Breakthrough in German-Polish Relations 1989-1991 in the Light of Polish Political Documents. A Selection of Documents by the Willy Brandt Centre for German and European Studies at the University of Wrocław (Poland), the fourth volume entitled "Symbolic Act. Benefits from Germany for the Victims of Nazi Crimes in Poland. The 'pragmatic' formula in the light of the 1991 and 2000 agreements". Introduction, selection and compilation by Jan Barcz and Krzysztof Ruchniewicz was published. The publication consists of two parts. The first part contains legal commentaries that provide a substantive introduction to the second part. Its authors are professors of international law Jan Barcz, Witold M. Góralski and Jerzy Kranz. The second part contains documents of Polish diplomacy and extra-diplomatic material. These sources are often published for the first time. The editors' intention was to fill a gap in the existing literature. Recent public discussions involving politicians, publicists and some researchers have shown us that the state of knowledge on this difficult subject is highly inadequate and does not correspond to the importance of this topic. The present volume was intended to be the last in the series, but due to the topicality of the subject of reparations and compensation claims to Polish victims of the Nazi regime, it was decided to change the order of the individual volumes. The electronic version (based on OpenAccess) will soon be supplemented by a paper version.  

W ramach serii wydawniczej Centrum Studiów Niemieckich i Europejskich im. Willy’ego Brandta UWr "Przełom w stosunkach polsko-niemieckich 1989-1991 w świetle polskich dokumentów politycznych. Wybór dokumentów" ukazuje się IV tom pt. "Akt symboliczny. Świadczenia z Niemiec dla ofiar zbrodni nazistowskich w Polsce. Formuła „pragmatyczna” w świetle porozumień z lat 1991 i 2000”. Wstęp, wybór i opracowanie Jan Barcz i Krzysztof Ruchniewicz. Publikacja składa się z dwóch części. W pierwszej umieszczono komentarze prawne, które stanowią merytoryczne wprowadzenie do drugiej części. Ich autorami są profesorowie prawa międzynarodowego Jan Barcz, Witold M. Góralski i Jerzy Kranz. W części drugiej zamieszczono dokumenty wytworzone przez polską dyplomację oraz materiały pozadyplomatyczne. Źródła te są często publikowane po raz pierwszy. Zamysłem wydawców było wypełnienie luki w dostępnej literaturze. Ostatnie dyskusje publiczne z udziałem polityków, publicystów i niektórych badaczy przekonały nas, że stan wiedzy w tak delikatnej materii jest wysoce niewystarczający i nie odpowiada poziomowi znaczenia tej problematyki. Prezentowany tom został przewidziany do druku jako ostatni w serii, jednak z powodu aktualności tematu reparacji i odszkodowań cywilno-prawnych postanowiono zmienić kolejność wydawania poszczególnych książek. Wersji elektronicznej będzie wkrótce towarzyszyć wersja papierowa.
