Abstract:

Providing normative protection with regard to the proper shaping of family relations is an expression of the correlation of legal and social norms. The actions of legal guardians taken in favor of the “child’s welfare” prove the actual application of the aforementioned guarantees, and the violation of the indicated regulations is sanctioned depending on the nature of the prohibited act exceeding the aforementioned standards. Considering the situations in which the violation of the aforementioned legal interest actually threatens the defenseless or unaware of their rights, the need to take remedial measures in the presented respect becomes justified. The legislator’s concern for the real protection of the rights of minors is reflected in the regulations falling within the scope of both criminal and civil law. The aim of this study is to present the correlation between the destructive behavior of the perpetrators and their negative impact on shaping the personality of minors against the background of theoretical and practical indications in the presented scope.
