Abstract:

The aim of the present study is a diagnosis of the current legal state in Poland regarding responsibility of web hosting providers. The author begins to present the issue by depicting reservations, which can be found in literature, in regard to solutions that exist in Polish legal system and which regard excepting responsibility of Internet service providers. The author will also show a real need of introducing changes, especially in regard to the procedure notice and takedown. The paper pays attention to description of proposals, of new law regulations, which appeared as answers to those needs. In order to provide broader view of the issues at hand, the author cites solutions that were approved in legislation of the United States which regard proceedings on illegal content.
