The purpose of the article is to present the minimum standards of the right of access to a lawyer at the earliest stages of criminal proceedings. Improving access to the lawyer in the Polish Code of Criminal Procedure by empowering the suspect to take advantage of this fundamental procedural guarantee has an impact, on the one hand, on the implementation of the principle of the right to defense by extending it to every person against whom criminal prosecution is directed. On the other hand, on increasing the standard of the right to a fair criminal trial. The implementation of the relevant changes to the rights resulting from Directive 2013/48/EU is intended to adjust the Polish Code of Criminal Procedure to the convention standard of human rights protection resulting from the International Covenant on Civil and Political Rights, the European Convention on Human Rights and Fundamental Freedoms, and the Charter of Fundamental Rights of the European Union.
