Abstract:

AbstractThe aim of the article is to answer the question of how to effectively protect the author’s right to appropriate remuneration, and at the same time to maintain a properly balance between the interests of the author and the person acquiring his or her copyrights. Therefore, the claim for an increase in remuneration provided for in the Copyright and Related Rights Act, which is an example of protection of the rights of the author in the continental copyright protection system, will be analyzed first, and then it will be compared with the American termination right, which is a part of the common law system in which the position of the author is shaped in a completely different way. Additionally, Dutch solutions will be presented as a kind of verification of Polish solutions.
