Abstract:

In the Criminal Code of France, the offense of non-alimony has been penalized in article 227-3. Under French law, the offense in question takes place when the person liable obligated to alimony fails to comply with a court decision or a court-approved contract which imposes an obligation to provide to a minor child, a descendant, an ascendant or a spouse, maintenance, shares, allowances or benefits due in nature, resulting from the fact of exercising parental authority. In this article, theoretical and legal analysis will be carried out on the statutory features of the offense of non-alimony under article 227-3 of the Criminal Code of France. Establishing effective solutions aimed at prosecuting the perpetrators of the offense of non-alimony and protecting the aggrieved party may constitute the basis for future changes in the structure of article 209 § 1 of Polish Criminal Code, if the Polish legislator decides to amend this provision again.
