Abstract:

To this day, the true significance of the Second Amendment to the Constitution of the United States of America is not obvious and generates many comments. Taking into account the doubts about the goals and ideological assumptions of the Founding Fathers and the resulting interpretation disputes, the judicature has approached it over the years in different ways. The purpose of this article is to analyze the content of the Second Amendment to the Constitution of the United States in the light of Supreme Court decisions. Due to the fact that the rudiment intention to introduce amendments to the Constitution was to adapt constitutional values to the changing view on political and social issues, the article shows how the interpretation of the Second Amendment modifies and evolves in the terms of time from its collective to individual approach. Due to the abundance of jurisprudence, the Author will present the important rulings that show how the linguistic meaning of the Second Amendment often leads to different interpretation decisions and how efforts made by social organizations change opinion of the public and, consequently, the jurisprudence of citizens’ access to weapons.
