Remarks on the concept of turpitudo in Roman law

Subject and Keywords:

turpitudo   infamia   ignominia

Abstract:

In his article, the author engages with the issue of human dignity – more precisely, with a detriment to it which took the form of infamia and turpitudo. Infamia is a precise concept. It arose as a result of disreputable lifestyle or resulted from either criminal or civil proceedings due to actiones famosae. Infamia was lifelong. By contrast, turpitudo is infamia in its non-legal, concrete form. It was not a result of legal requirements – rather, it arose from negative public reputation, which in turn can be dubious, and even unjust. The author accepts the view that turpitudo is a less precise form of infamy.
