Abstract:

The Criminal Ordinance (1707) of Joseph I, although it was to be applied in all courts in Silesia dealing with criminal cases, did not unify the courts' organization, but in principle left it unchanged. As a result of this, not only similarities but also differences occurred in the evolution of the organization of courts in individual principalities and countries in Silesia. Therefore, the courts provided for in the ordinance did not always correspond to the courts that existed in practice in Silesia. This formulation is confirmed by the provisions of the ordinance and by the arrangements concerning the organization of courts in Silesia made by Professor Marian Józef Ptak.
