Abstract:

The legislative process and issues of the temporal and territorial scope of the Polish act on combating unfair competition of August 2nd, 1926, are discussed in the article. Initially the Act on combating unfair competition did not apply to the territory of Silesia, which has not been the case duly noted in the legal-historical doctrine. In the Silesian Voivodship, the Act came into force only at the moment of expressing appropriate consent by the Silesian Parliament, which happened in April 1932. Moreover, the issue of the validity of the Act after the Second World War and related interpretation problems are pointed out in this article.
