Abstract:

The image is a hallmark of every human being who is his personal good, and as such is subject to special protection. Dissemination of a person’s image requires, in principle, consent from the user, and therefore her unlawful use constitutes a violation of that good. However, the Copyright Act and Related Rights introduce some exceptions to this general rule, stating that, where dissemination concerns a person who is merely a detail of the whole, such as an assembly, such consent is not required. The object of this article is therefore to present and define the limits of the protection of the image of the participants of the assembly as a whole within the meaning of art. 81 sec. 2 pt. 2 Copyright Act and Related Rights.
