Abstract:

Spontaneous assemblies are a type of public assembly that aims to address a current political or social event that has shocked public opinion. These congregations usually take the form of marches or demonstrations by those taking part in them. The essence of this is that each participant will be able to speak in public in connection with a sudden and unforeseen event. In view of the characteristics of spontaneous gatherings and the number of cases referred to the Strasbourg Court, he argued that taking a spontaneous and impulsive response to the event justifies the impossibility of prior notification to the competent authority, which would make no sense. At the same time, the Court points out that not every public assembly can be considered as a spontaneous assembly, because not every assembly is an immediate response to a specific event and should therefore be notified.
