Abstract:

The Constitutional Court in the judgment of Kp 1/17 stated that the Act amending the Act - Law on Assembly is consistent with the Constitution. This Act introduced the so-called cyclical assembly. However, prima facie the Act is contrary to international standards for the protection of freedom and human rights and fundamental principles such as right to court, principle of equality or lex retro non agit. In addition, it raises doubts the composition of the Constitutiona Court. The consequences of the CC judgment Kp 1/17 is restrictions of freedom of the assembly.
