Although this concept has been the subject of numerous controversies under the Warsaw Convention, its legal definition has still not been introduced in the new legal act. In an unprecedented Judgment of 19 December 2019 (case C 532/18), the Court of Justice of the European Union had to deal with the interpretation of this concept and specify the circumstances qualifying a given event as an “accident”. In reply to the question referred, the Court took the view that there is no need to determine whether an incident classified as an “accident” relates to arisk characteristic of air transport.
