Firstly, it strengthens the EU’s established line of case-law jurisprudence, regarding qualified breach of law in a form of obvious and grave infringement of the bounds of its discretion. The judgment distinctly indicates the bounds of discretion in a form of due diligence and proportionality; it also clearly shows when they are exceeded. Secondly, this judgment seems to be a precedent regarding the scope of application of the precautionary principle and thus for the protection of the human health and life.
