The basis of considerations is judgment of the Court of Justice of 8 February 2017 in case Carrefour Hypermarchés SAS versus ITM Alimentaire International SASU. The purpose of the gloss is to approve settlement made by the Court of Justice in mentioned case. Therefore, the situation pictured in this judgement was analysed in the context of conditions situated in directive 2006/114. The purpose of including regulations about comparative advertising to EU regulations had been examined, then the analyses of regulations about acceptability of comparative advertising was done and how they are interpretated in the context of judgment of the Court, and detailed analysis of judgment and opinion of the Advocate General. In this context the most important thing was to show influence of size or format difference of stores with fulfilment of conditions by comparative advertising. Those issues were extended by influence of judgment to Polish law, even though there was not any case in which this judgment was the basis. Also, it was extended by showing other limitations which could occur for advertising, not just comparative one, and at the end of the commentary, the advertising wars were mentioned. The gloss presented that actual legal regulations need to be analyzed different for every case.
