 abstract={This work attempts to bring closer the subject of individual rights and freedoms in the face of contact with the state apparatus and the administration of justice. The examples cited in the study show a cross-section of case law in various European countries that are parties to the European Convention on Human Rights, prove how long and difficult the path a single citizen must travel to ensure that his elementary rights are respected and respected. By familiarizing ourselves with the opinions of the European Court of Human Rights and comparing the German and Polish constitutional complaints, we try to show the essence of the above-mentioned problem and the ways of resolving it in the selected case law},
