Wydział Prawa, Administracji i Ekonomii Uniwersytetu Wrocławskiego}, language={pol}, language={eng}, abstract={In the presence of lack of a specific methodology of proceeding while determining the legal nature of the complaining mixed legal entities by polish Constitutional Tribunal and on the basis of several judgements, we identified three criteria, the application of which may help to make conclusions about the public or private legal nature of such entities. After some general considerations, we started to characterize the historical criterion, focusing mainly on the origin of a given company and determining its original qualities. In the next step, we referred to the property criterion, which assumes the analysis of parts of the share capital of the companies and the determination their nature on this basis. The most extensive, the functional criterion concerns primarily the identification of the entity that benefits most from the company's operation, as well as indication who has the biggest impact on its functioning. In this part, we gave many examples, including organizational regulations, as well as the practices of actions taken by legal entities.
