 abstract={The Author explains how a traditional public-private divide affects the constitutional status of State-owned commercial companies undertaking business activity in Poland. Polish constitutional law has not provided conclusive classification of companies whose shares belong to both private and public share/stock holders (mixed companies). Such ambivalence and its impact on freedom of information legislation and EU law on re-use of public sector information may result in significant loss of transparency or violation of right to private property.
