 abstract={The purpose of this article is to examine the issue of formalism in the Polish criminal process, taking into account both its latest manifestations and the established practices of procedural authorities. The author also advocates legislative postulates, both in terms of direction and specific changes. A theoretical analysis of the formalism issue is carried out, and its definition is formulated and at the same time the background of social legitimacy is included. Practical experiences related to the criminal process also play a significant role. This issue is certainly of great importance, especially in functional terms, and it is the subject of interest for legislators considering directions for changes in regulations related to the Polish criminal process.},
