 abstract={In the presented article, the author examines the current jurisprudence of the European Court of Human Rights in terms of the standards set by it regarding the investigative method, which is police provocation. It presents the definition of police provocation developed by the ECHR and indicates the legal basis for the complaint in the form of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms. The author indicates standards and evaluates them in terms of their uniformity and consistency. This study points to the distinction between the active and passive attitude of the functionaries carrying out the operations, and also identifies the two-stage test used by the tribunal examining the limits of the legality of provocation. As a result of the analysis, the author indicates the risks and threats to the legality of the provocation related to the person of the functionary who carries it out against the background of the standards of a democratic state.},
