Striving to achieve a sense of compensation for the injured party, meeting his/her personal expectations in response to the creation of a sense of injustice he/she experienced in connection with the crime committed against him/her and the possibility of expressing effective active regret by the perpetrator – reinforces the reality of criminal proceedings in relation to the use by the litigants of consensual ways of ending criminal proceedings. However, based on the presented theoretical assumptions, it is justified to seek answers to the question about the effectiveness of criminal mediations based on the implementation of the idea of restorative justice. The inspiration to undertake the indicated research problem came from my own observations made in connection with my procedural practice.
