 abstract={The text is focused on the business risks arising from the use of AI tools in enterprises – related to the lack of emergence of copyrights to AI generations or related to the lack of effective acquisition of copyrights to AI generations rights. The analysis contained in the text presents the genesis of the emergence of such risks, related to the level of preparation of entrepreneurs for the implementation of AI tools in their companies, and then discusses selected examples of such risks. The authors of the text focused on discussing the risks arising from the disputed legal status of AI generation under copyright law (in particular in the IT industry) and the practical consequences of not acquiring copyright in works created using AI – taking into account the jurisprudence of EU member state courts in this regard. The analysis of business risks is discussed in particular in the context of the employee-employer relationship and in the context of the employer-client relationship. The analysis in the text also includes a review of the areas of risk management related to the use of AI tools. The text also discusses solutions used by legal practitioners to secure the discussed risks, presenting and analysing examples of solutions on the grounds of contract law and examples of appropriate preparation of entrepreneurs and employees for responsible use of AI tools.},
