At the very beginning, the article describes the sources of these views, i.e. how Karl Marx and Friedrich Engels viewed law and the state. The fathers of Marxism conceived of both law and the state in the sphere of the superstructure, seeing in them mainly an alienated apparatus of oppression, which the bourgeoisie uses against the proletariat. In fact, Trotsky's views on the problem of law are mainly the aftermath of how the state and law were seen by Marx and Engels. In the next section, the article focuses on what the law looked like in the Soviet Union, briefly describing the legal nihilism of the Bolsheviks. In the last part, the article describes Trotsky's views, stating that he saw law purely instrumentally. According to Trotsky, the law was a tool of social engineering. Thanks to him, the Bolsheviks were able to create a new order entirely devoted to the ideology of communism.
