  The dynamic growth of new technologies industry in the past few decades establishes quite a challenge for legislators in terms of efficient and appropriate regulation of particular issues. The issue of decompilation is a crucial element for economic turnover. For licensors, uncertain regulations may threaten know-how of their computer programs. The subject of the present considerations is the protection of computer programs under directive 2009/24/EC of 23 April 2009 on legal protection of computer programs and the legal nature of decompilation as a potential threat for licensors. Decompilation will be shown in the technical aspect and in the context of premises legalizing the scope of its legal execution and use of effects. The purpose of this analysis is to indicate that the current legal regulations and technical aspect of decompilation do not pose a serious threat to copyright, and are even conducive to the development of the entire industry. In addition, the author offers a solution for contractual provisions that will protect the interests of licensors and will comply with legal requirements.;
  
  
  
  Dynamiczny rozwój branży nowych technologii w ostatnich kilku dekadach stawia ustawodawcom nie lada wyzwanie w zakresie sprawnego i odpowiedniego regulowania poszczególnych zagadnień. Kwestia dekompilacji programów komputerowych stanowi niezwykle newralgiczne zagadnienie o szczególnym znaczeniu dla obrotu gospodarczego. Niepewne regulacje prawne stanowią poważne zagrożenie dla know-how licencjodawców programów komputerowych. Przedmiotem niniejszych rozważań jest przedmiot ochrony programów komputerowych w dyrektywie Parlamentu Europejskiego i Rady 2009/24/WE z 23.4.2009 r. w sprawie ochrony prawnej programów komputerowych oraz prawne aspekty dekompilacji programów komputerowych jako ewentualnego zagrożenia dla licencjodawcy. Dekompilacja zostanie przedstawiona w aspekcie technicznym oraz w kontekście przesłanek legalizujących zakres jej legalnego wykonywania i wykorzystywania efektów. Celem niniejszej analizy jest wykazanie, że aktualny stan prawny i techniczny aspekt dekompilacji nie stanowią poważnego zagrożenia dla praw autorskich, a wręcz sprzyjają rozwojowi całej branży. Ponadto autor proponuje postanowienia umowne, które zabezpieczą interes licencjodawców, jednocześnie czyniąc zadość wymogom prawnym.
