The principle of equality and a ban on discrimination do not exclude both genders from being treated differently. Privilege of one of them requires justification. In the social welfare law treating women in a special way results from the natural law and is closely connected with maternity. Their socio-legal welfare involving pregnancy period, birth and early maternity should not be questioned. Other cases of privilege may have features of discrimination, which might be reflected in receiving social welfare benefits more frequently. Nevertheless, such a situation is conditioned by a number of legal, social and cultural circumstances such as single parenthood, domestic violence or feminization of poverty.
